Prisoner sues Credit Union over Repossession of Truck (ute)

Koehler (the debtor) an prisoner / inmate is a Texas jail has filed a lawsuit against Amoco Federal Credit Union and its collections manager for improperly terminating his loan contract. According to the particulars of the case, Koehler and Amoco Federal Credit Union entered into a loan contract to purchase a 2007 Ford F-150 pickup truck (ute).

Koehler had setup a sub-account, whereby an automatic loan payment was made from his personal account to the sub-account as the monthly payments on the truck / ute.

Koehler then committed an unspecified crime and was subsequently convicted and given a life sentence.

Subsequently, Amoco Federal Credit Union repossessed the truck. In his claim, the debtor insisted that the account was up to date.

The lawsuit advises that the truck was repossessed despite the debtor attempted to make further arrangements, claiming the credit union prevented him from making his monthly payment. Consequently the debtor is seeking $40,000 in damages, and is representing himself in court.
