NSW Local Court threshold Increased

18-Apr-2011 The NSW Local Court increased the threshold / jurisdictional limit for claim from $60,000 to $100,000 (with the exception of personal injury or death claims where the limit remains at $60,000).

This is a good news for collecting your debts as there are a number of procedural changes required and additional costs involved when lodging in the District Court including;
- Personal service must be effected in the District Court (cannot serve via post)
- Service must be effected within 28 days of the SLC in the District Court. Otherwise you have to issue another SLC. The Local and Supreme Courts allow 6 months for Service.
