Creditors and Plaintiffs Must Swear Judgment Affidavit Verifying QLD Magistrates Court

The courts in Queensland recently advised that all Judgment applications must be accompanied by an Affidavit sworn by the Plaintiff. This is a change from historical practice and other jurisdictions that allow the solicitor on the record, or an employee of the solicitor on the record to perform the affidavit.

LCollect is aware that there is movement to have this ruling overturned and returned to the previous practice.

The practical outcome of the current arrangement is that we are required to seek from all our clients seeking to enter Judgment in Queensland an Aaffidavit. We will keep you informed should this requirement change.
